What is an Estate Plan?

An Estate Plan that ensures that your family and financial goals are met after you die. An Estate Plan usually has several elements, which include: a Will, a Power of Attorney for Property Management, and an Advance Health Care Directive (also known as Medical Power of Attorney). For some people, a Trust may also make sense.

This is all sort of morbid. Do I really need to think about these things?

Few people like to think about estate planning. After all, deciding how you want your assets distributed after you die can serve as an unnerving reminder of your mortality. But there are plenty of reasons to tackle the task with some enthusiasm:

  • You get to name the people to whom you wish to give your assets and know that your wishes carry the word of law.
  • You can plan to minimize taxes.
  • You have the satisfaction of knowing that your financial affairs are in order and that when you die, your loved ones will not have to deal with a costly administrative nightmare.
How much does a lawyer-designed Estate Plan cost?

At Modlin Legal Services, I design my clients' Estate Plan and draft custom documents for a flat fee.  I obtain client approval of my fees before any drafting takes place, thus eliminating the element of surprise and allowing my clients to control their legal spending.

Do I need to do anything else once I complete the Estate Planning process?

Yes, as your life changes, your Estate Plan must change. For example, most married couples execute their Durable Powers of Attorney designating their spouse as their agent. In California, a divorce immediately invalidates your Durable Power of Attorney. Thus, if you were recently divorced, a new Durable Power of Attorney should be drafted as soon as possible.

It is hard to predict which life changes will require an Estate Plan revision. Thus, it is best to discuss each life change with an attorney at Modlin Legal Services.
